Changes in the biogas industry introduced by the amendment to RES Act

On October 5, 2021, President of Poland, Andrzej Duda signed the amendment to the RES Act. The new regulations extend, inter alia, support programs under FiT and FiP, which were in force until December 31, 2021. The possibility of obtaining operating aid for an additional 2 years period has also been introduced for some biogas installations benefiting from FiT and FiP support.

Thanks to the proposed changes, support programs related to the sale of electricity at a fixed price (FiT system) or the right to subsidize the electricity market price (FiP system) were extended until June 30, 2024. The possibility of obtaining operating aid for an additional 2 years period was also introduced - only in the FIT and FIP systems for biogas installations with a capacity not exceeding 1 MW, which used the green certificate system for a minimum of 5 years. As a result, around 80 landfill biogas installations and other biogas plants with an installed capacity of up to 1 MW will benefit from the support scheme allowing operating aid up to 17 years. The regulations apply to installations for which the 15-year support period has expired or will expire in the current and subsequent years.

The new regulations also introduce the possibility to define a long-term schedule of providing support to RES producers for the next six years. The maximum volume and value of electricity from RES that can be sold at action in 2022-2027 will be set out in the regulation. The Council of Ministers will only be able to increase the volumes and values of electricity scheduled for particular years. The purpose of this solution is to create a predictable framework for the development of the RES sector and to ensure a stable investment perspective.

The Minister of Climate and Environment, Michał Kurtyka, announced that at the end of October, work on a sectoral agreement with the biogas and biomethane industry should be completed. The signing of the agreement is to contribute to the acceleration of the development of the biogas sector and the introduction of legal solutions aimed directly at biomethane.
